Sales Policy
General Terms
Intellectual Property
The trade names, trademarks, trade dress, copyrights, patents, domain names, product names, catalogs, and any other intellectual property rights maintained by Yazanz, as well as any trademarks or service marks owned by Yazanz’s suppliers, shall not be entitled to, or interest in, by the customer. The ownership rights of Yazanz and its suppliers apply to all materials found on www.Yazanz.com. Without Yazanz’s consent, the customer is not permitted to duplicate or utilize any of Yazanz’s or its suppliers’ intellectual property.
Force Majeure
Yazanz shall not be liable for any delay in, or impairment of, performance resulting in whole or in part from any force majeure event, including but not limited to acts of God, labor disruptions, acts of war, acts of terrorism (whether actual or threatened), governmental decrees or controls, insurrections, epidemics, quarantines, shortages, communication or power failures, fire, accident, explosion, inability to procure or ship product or obtain permits and licenses, inability to procure supplies or raw materials, severe weather conditions, catastrophic events, or any other circumstance or cause beyond the reasonable control of Yazanz in the conduct of its business.
Severability
If any portion of these terms and conditions is found to be invalid or unenforceable by a court of competent jurisdiction, the invalid or unenforceable term shall be severed from these terms and conditions, and the remaining terms and conditions shall be valid and fully enforceable as written.
Modification of Terms
Any order that Yazanz accepts is dependent upon the buyer agreeing to all of the terms and conditions stated below. When the customer accepts all or any portion of the products they have ordered, or when they receive Yazanz’s acknowledgment, it is assumed that they have agreed to these terms and conditions. Customer additions or changes to Yazanz’s terms and conditions will not be enforceable against Yazanz unless approved in writing by a Yazanz representative. Yazanz’s fulfillment of any such purchase order is not to be taken as assent to any of the terms and conditions if a purchase order or other correspondence submitted by the customer contains terms and conditions that are contrary to or in addition to the terms and conditions contained herein or in Yazanz’s acknowledgment.
Complete Agreement
The terms and conditions in: (i) Yazanz’s forms, (ii) acknowledgments, (iii) quotations, (iv) invoices, (v) websites, (vi) catalogs are incorporated herein by reference, and constitute the entire and exclusive agreement between customer and Yazanz.

These Terms of Access (“Terms”) govern all usage and access to this website, as well as any other websites (including mobile websites), applications, or other services that are referenced here (collectively, the “Yazanz Property”) and the features found here. Yazanz and its parent company, subsidiaries, division, affiliates, and brands collectively referred to as “Yazanz” are the owners or controllers of the Yazanz Property. You acknowledge and agree to be bound by the terms, conditions, policies, and notices contained here (the “Terms”), including but not limited to conducting this transaction electronically, disclaimers of warranties, damage, and remedy, by accessing this Yazanz Property in any way, including, without limitation, browsing this Yazanz Property, using any information, and/or submitting information to Yazanz.
We can modify these Terms and this Yazanz Property from time to time. Once we post any updates to these Terms, your use of this Yazanz Property will be considered your acceptance of those changes. You acknowledge that you have no ownership interest in this Yazanz Property and that Yazanz will not be liable to you in the case that Yazanz discontinues this Yazanz Property or your access to it.
You accept the risk that the information on this Yazanz Property may not be correct, up to date, full, or satisfy your needs and requirements by using this Yazanz Property or by linking to it. Any information, features, and other content included in this Yazanz Property may be added, changed, discontinued, removed, or suspended at any time, without prior warning or liability.

Yazanz Content
The information provided by Yazanz or its licensors on this Yazanz Property, such as certain pictures, photos, images, screenshots, text, digitally downloadable files, trademarks, logos, program and product names, slogans, and the compilation of the aforementioned information (collectively, “Yazanz Content”), is Yazanz and its licensors’ property and is protected by copyright, trademark, and other intellectual property laws in the United States and other countries.
You undergo not to download, display, or use any Yazanz Content found on the Yazanz Property for use in publications, public performances, on websites other than this Yazanz Property for any unauthorized commercial purpose, in conjunction with non-Yazanz products or services, or in any other way that could be construed as confusing, denigrate or disparage Yazanz and/or its licensors, weaken the intellectual property rights of Yazanz or its licensors, or otherwise violates the intellectual property rights of Yazanz or its licensors (including through the use of screen scraping, web harvesting, data extraction, or comparable software or technologies). Furthermore, you consent to not mishandle any User Content or Yazanz Content that appears on this Yazanz Property in any other way.
Use of the Yazanz Property and Posting Policy
You must adhere to the following guidelines in order to use the Yazanz Property: (a) You will not use the Yazanz Property’s electronic communication features for any unlawful, tortuous, abusive, invading another person’s privacy, harassing, libelous, defamatory, embarrassing, threatening, or hateful purpose; (b) You will not upload, post, reproduce, or distribute any data, software, or other material protected by copyright or any other intellectual property right (including rights of publicity and privacy) without first obtaining permission from the owner of such rights; (c) You will not gather or retain personal information about other users; (d) You will not use the Yazanz Property for any commercial transactions that are unrelated to the goals for which the Yazanz Property was provided; (f) You will not upload, post, email, or otherwise transmit any material that contains viruses or any other computer code, files, or programs which might interrupt, limit, or interfere with the functionality of any computer software or hardware or telecommunications equipment. (e) You will not upload, post, email, or otherwise transmit any advertising or promotional materials or any other form of solicitation or unauthorized communication on interactive features intended for the general public.
There may be instances when you are able to post reviews and other content (“User Content”) on specific Yazanz Property locations. By using these features, you consent to posting any content that Yazanz considers unlawful, harmful, tortuous, defamatory, libelous, obscene, invasive of another person’s privacy, threatening, harassing, abusive, hateful, racist, infringing, pornographic, violent, or otherwise objectionable or inappropriate. You also agree that you won’t post any content that contains personal information about any individual, violates the privacy or publicity of any other individual or entity, or that you have a contractual obligation to keep private or confidential. Finally, you promise not to impersonate anyone or organization, including but not limited to Yazanz staff, or misrepresent. You promise not to publish any content that could negatively impact the Yazanz Property’s functionality or features, such files that are corrupted, viruses, or other similar malware. You also acknowledge and concur that you have no ownership rights in any account you may have with us, nor do you have any other access to the Yazanz Property or its features. If Yazanz believes that you have broken any of these Terms, the law, or for any other reason, Yazanz has the right to terminate your account and remove all User Content connected to it immediately and without prior warning. Yazanz maintains the right to permanently limit access to the Yazanz Property or a portion of it, and assumes no liability for any information removed from our Yazanz Property.
You authorize Yazanz a limited, nonexclusive, sublicensable, worldwide, fully paid, royalty-free license to use, modify, publicly perform, publicly display, reproduce, and distribute any User Content in any and all media now known or hereinafter developed without having to pay you or any third party or obtain permission from any third party. This license is granted by displaying, publishing, or otherwise posting any User Content on or through the Yazanz Property. This license gives you the ability to sublicense User Content to other users and third parties for use on known or future media or platforms, as well as the ability to host, index, cache, distribute, and tag any User Content.
Except as permitted by these Terms and the license outlined below, you remain to be the sole owner of your User Content and to use it however you see fit. You affirm and warrant that the content you submit, display, publish, or post on the Yazanz Property is your own, that you have the authority to grant the license described below, and that our use of the content you submit does not and will not infringe upon your right to privacy, publicity, copyright, trademark, patent, contract, or any other intellectual property right or other rights of any person or entity. Despite this, you understand that concepts, ideas, materials, proposals, suggestions, and the like pertaining to Yazanz or our activities may be included in your User Content (your “Ideas”). Regarding the Ideas, you understand and agree that: (a) Yazanz may have independently developed and/or considered similar Ideas, and that Yazanz receives a lot of submissions from various sources; (b) Yazanz is free to use any similar Ideas, whether they were developed independently or in response to third parties, based on your User Content, or otherwise, without being subject to any obligation to you.
Indemnification
In the event that you violate any of these terms, including the posting policy, or if Yazanz or this Yazanz Property is used in connection with any User Content you submitted, posted, or otherwise provided to Yazanz, you agree to indemnify and hold harmless Yazanz, its parents, subsidiaries, officers, employees, and website contractors, as well as each of their officers, employees, and agents.
Representations and Limitations of Liability
Yazanz disclaims all duty in the event of a service failure and makes no assurances regarding the dependability of any feature of this Yazanz Property, the Content, User Content, or any other feature. You understand that you will bear all risks associated with using such materials or systems. Regarding the duration for which any Content or User Content will be retained, Yazanz provides no guarantees.
Yazanz does not recommend, confirm, assess, or guarantee any information submitted by users, and nothing on this page should be interpreted as endorsing, validating, or endorsing any User Content. It is forbidden for you to produce or disseminate any kind of content, including but not restricted to press releases, ads, or other marketing materials, or to include links to any websites.

There may be links on this Yazanz Property to external websites that are not run by Yazanz. Yazanz disclaims any liability for the privacy practices and other rules pertaining to those websites. Any link to these websites does not constitute endorsement, sponsorship, or recommendation of the linked websites by Yazanz. Yazanz disclaims any responsibility for links that lead to other websites and vice versa (i) within the Yazanz Property.
Miscellaneous
Notwithstanding considering conflicts of laws rules, the internal laws of Illinois shall control and be construed in conformity with these Terms. By accessing this website, you thereby consent to the jurisdiction of the courts in Lake County, Illinois, for any disputes arising out of these Terms. To the extent permitted by law, these Terms apply. It may not be legal for some people in some countries to access the contents on this Yazanz Property, and Yazanz makes no guarantees that the materials on this Yazanz Property are suitable or available for use in places other than the United States. You use this Yazanz Property at your own risk, initiative, and compliance if you choose to access it from a location outside of the United States.

Yazanz does not give up its right to take action in the future or in response to similar or subsequent violations if it does not take action about your violation or another violation on any occasion.

You acknowledge these Terms by using the Yazanz Property, and they become a legally enforceable agreement between you and Yazanz. The whole understanding between you and Yazanz about your use of the Yazanz Property is included in these Terms. By using the Yazanz Property, you confirm to your ability to form a legally binding contract and your acceptance of these Terms.
